New Administrative Process Begins on 340B Rebate Models
The day after the U.S. Dept. of Health and Human Services (HHS) and the American Hospital Association, Maine Hospital Association, and four health systems filed its joint motion requesting the court vacate the 340B Rebate Pilot and send it back to HHS in the lawsuit against HHS alleging it violated the Administrative Procedures Act (APA), it started the administrative process for new rebate models.
On Feb. 6, 2026, HHS filed a “prerule” on “340B Drug Pricing Program Manufacturer Rebate Models” for regulatory review by the Office of Management and Budget (OMB). It is unclear how long OMB’s review process will take but it is possible that a comment period could begin soon.
IHA encourages all hospitals that would be impacted by a 340B rebate model to begin gathering information and preparing comments, especially about the costs and administrative burdens that a 340B rebate model would impose on them. This includes administrative compliance costs (e.g., staff, vendors), operational difficulties with the IT platform Beacon, the cost to pay upfront and wait for a rebate, and the impact these costs will have on patients.
IHA will release additional information as the prerule continues through the regulatory review process.
Illinois General Assembly Legislative Update
The Illinois Senate met last week, though adjourned one day early, canceling its scheduled Thursday session. The Illinois House was not in session last week. Friday was the deadline for filing new bills in each chamber; more than 2,600 bills have been introduced in the House and the Senate since Jan. 1. Both chambers are off this week but are scheduled to reconvene Feb. 17-19. They will come together in a joint session on Wednesday, Feb. 18. to watch Gov. JB Pritzker deliver his combined Budget and State of the State Address.

White House Launches TrumpRx Platform
The White House last week launched the TrumpRx website, saying patients will be able to access large discounts on many of the most popular and highest-priced medicines in the country. The White House said the prices are in line with the lowest paid by other developed nations (known as the most-favored-nation, or MFN, price). The administration said it reached MFN agreements with several drug companies, including AstraZeneca, Eli Lilly, EMD Serono, Novo Nordisk and Pfizer. Additional drugs from other companies that have signed MFN pricing deals will be made available through TrumpRx.gov in the coming months.
Illinois Respiratory Disease Surveillance Data
The Infectious Respiratory Disease Surveillance Dashboard from the Illinois Dept. of Public Health (IDPH) provides the latest data on hospital visits, seasonal trends, lab test positivity and demographic data. IDPH also tracks COVID-19, influenza and respiratory syncytial virus information through the Illinois Wastewater Surveillance System dashboard.

J&J MedTech and their subsidiary, CERENOVUS Inc., have issued a recall of certain CEREPAK products due to a higher-than-expected failure to detach rate. Failure to detach could result in hemorrhagic and ischemic stroke, procedural delays, or the need for additional surgical intervention. There have been four serious injuries and one death associated with this issue.
