U.S. District Court Rules Against J&J in HHS and 340B Case
On June 27, the U.S. District Court for the District of Columbia ruled against Johnson & Johnson (J&J), siding with the U.S. Dept. of Health and Human Services (HHS) and hospitals in a lawsuit brought by J&J that opposed the government’s authority to reject J&J’s proposed 340B rebate model.
“In sum, based on the plain and unambiguous language of the 340B statute, and supported by its purpose and history, [Health Resources and Services Administration (HRSA)] has the authority to ‘provide’ for discounts, rebates, or both,” Judge Rudolph Contreras ruled. “This conclusion defeats J&J’s claim that HRSA lacked the authority to require prior approval of J&J’s rebate model.”
Earlier this year, a second district judge reached the same conclusion in cases brought by five other drug companies.
IHA, in a joint friend-of-the-court brief (i.e., amicus brief) with 36 other hospital associations, encouraged the court to uphold the government’s decision to reject J&J’s proposed 340B rebate model. The American Hospital Association (AHA), the Children’s Hospital Association, the Association of American Medical Colleges and America’s Essential Hospitals have also filed an amicus brief.
DEADINE TODAY: Medicaid IMPACT Revalidations Due for June Cohort
The Illinois Dept. of Healthcare and Family Services (HFS) is in the process of conducting IMPACT Medicaid provider revalidations. Providers in the June cohort must complete IMPACT revalidations by today, June 30. Completing this information is necessary to continue receiving Medicaid reimbursement. If you are in this revalidation cycle and do not submit your revalidation information by June 30 you will be disenrolled from the IMPACT system and cannot receive retroactive enrollment. IHA urges all providers to check their revalidation cycle due date, as well as the servicing providers affiliated with their hospital, and submit necessary information to complete their revalidation. To check your revalidation due date, search the basic information page of your IMPACT enrollment. HFS has provided IHA with step-by-step instructions to check the status and due date of servicing providers that you can access here. IDFPR Launches Another 18 License Types on New Licensing System
The Illinois Dept. of Financial and Professional Regulation (IDFPR) announced last Friday that 18 more professions are now available for initial licensure via IDFPR's new online licensing system, CORE (Comprehensive Online Regulatory Environment). The announcement marks the completion of CORE’s Phase 2.2, with all of Phase 2 set for completion in the coming weeks. The Department will announce when each part of Phase 2 is completed, including which professions are added to CORE. To date, 46 initial professional license applications are now available on CORE. CISA Urges Vigilance Against Potential Iranian Cyber Threats
Today, the Cybersecurity and Infrastructure Security Agency (CISA), in collaboration with the Federal Bureau of Investigation, the U.S. Dept. of Defense Cyber Crime Center, and the National Security Agency, released a fact sheet urging organizations to remain vigilant against potential targeted cyber operations by Iranian state-sponsored or affiliated threat actors. Despite a declared ceasefire and ongoing negotiations towards a permanent solution, Iranian-affiliated cyber actors and hacktivist groups may still conduct malicious cyber activity.
While the organizations said they have not seen indications of a coordinated campaign of malicious cyber activity in the U.S. that can be attributed to Iran, CISA and its partners are strongly urging critical infrastructure asset owners and operators to implement the mitigations recommended in the joint fact sheet.
