Reminder: Hospital Child Abuse Posting Requirement
The Child Abuse Notice Act (
P.A. 103-0813) requires a variety of businesses, including emergency rooms within general acute care hospitals and urgent care centers, to post a notice aimed toward children under 18 that provides information on what constitutes physical and sexual abuse and how to report such abuse. The Illinois Dept. of Children and Family Services recently developed a
model notice for businesses to comply with implementation of the law.
We encourage emergency rooms within general acute care hospitals and urgent care centers to post the notice immediately.
This week, it was brought to IHA’s attention that hospitals are being contacted by interested stakeholders to verify their compliance with the Act. Businesses that do not comply with the Act’s posting requirements
may be found guilty of a petty offense, and subject to a fine of up to $500 for each violation. See the Sept. 29
IHA memo summarizing the Act’s requirements related to posting and further details on penalties for non-compliance.
Hospital Licensing Rules Codifying Legislation Adopted
The Illinois Dept. of Public Health has adopted amendments to the Hospital Licensing Requirements (77 Ill. Adm. Code 250 et seq.), (Sept. 12,
Illinois Register). The adopted amendments, which are now effective, codify recent statutory changes made to the
Hospital Licensing Act pursuant to
P.A. 103-0803 and
P.A. 103-0948. Enacted in 2024, P.A. 103-0803 expands the reporting requirements for patient abuse to include a hospital affiliate. P.A. 103-0948 creates a certificate of birth resulting in stillbirth, known as Liam’s Law.
